ARIS Terms of Service
Version 1.1 — Effective September 16, 2026
These Terms of Service ("Terms") govern your use of the ARIS website, account portal (app.aristrials.com), and related online services (the "Service") provided by Cody Shofner, doing business as ARIS ("ARIS", "we", "us"). Use of the ARIS desktop and mobile applications is additionally governed by the ARIS End User License Agreement (the "EULA", https://app.aristrials.com/eula), which is incorporated by reference. By creating an account or using the Service you agree to these Terms, the EULA (including its arbitration agreement and class action waiver), and the Privacy Policy. If you are accepting on behalf of an organization, you represent that you have authority to bind it.
1. Accounts
You must provide accurate information and keep your password and access codes confidential. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority where you live. One person per seat; accounts and seats may not be shared, pooled, or transferred. We may refuse or close accounts at our discretion, including accounts created by or for competitors (see EULA section 4) or with disposable email addresses.
2. Free trial
New accounts receive a free trial of the length stated at sign-up (normally 30 days). The trial period is tracked on our servers. One trial per person or organization; creating additional accounts to extend evaluation is a breach of these Terms. We may extend, shorten, or end trials at our discretion. When a trial ends, the applications continue to open but new work requires a paid plan or an extension code.
3. Plans, billing, and renewal
Paid plans (Academic, Professional, Enterprise) are priced per seat as shown on the Plans page at the time of purchase. Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price until you cancel. You may cancel at any time from your account page or by emailing cody@aristrials.com; cancellation takes effect at the end of the current period, and fees already paid are non-refundable except where required by law. We will notify you by email before an annual renewal. We may change prices with at least 30 days' notice before your next renewal. Taxes are your responsibility. Academic pricing is limited to accredited educational institutions and their staff and students; we may request verification and may convert unverified accounts to Professional pricing.
4. Acceptable use
You will not: share seats or credentials beyond your plan; use the Service to store or process data you have no right to process; attempt to access other users' data; probe, scan, test the vulnerability of, or overload our systems; use automated tools to access the Service; reverse engineer the Service or the applications; frame or mirror any part of the Service; misrepresent your identity or affiliation; or use the Service in violation of law. We may suspend accounts that breach these Terms without refund.
5. Your data and synchronization
You own the trial data you create. The optional phone-to-desktop synchronization feature transmits encrypted bundles through our servers, where they are held only until your desktop retrieves them or for a maximum of 30 days, then deleted. We do not read the contents of these bundles except as necessary to operate the Service, and we never sell your data. See the Privacy Policy for details.
6. Intellectual property and confidentiality
The Service, the applications, and all content we provide are owned by ARIS and protected by copyright, trademark, and trade-secret law. "ARIS", "ARIS Field", "Agriculture Research Intelligence System", and the ARIS logo are trademarks of Cody Shofner. No rights are granted except as expressly stated in these Terms and the EULA. Non-public features, pricing offers, and pilot or pre-release functionality are confidential and may not be disclosed.
7. Copyright complaints
If you believe content on the Service infringes your copyright, send a notice under 17 U.S.C. § 512 to cody@aristrials.com with the subject "DMCA notice" including the required elements. We respond to valid notices and may terminate repeat infringers.
8. Third-party services
We rely on third-party providers to host the Service, send email, and process payments (currently Vercel, Neon, Resend, Stripe, and GitHub). Their availability affects ours. Payment card details are handled by Stripe and never stored by ARIS.
9. Disclaimer and limitation of liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OR CROPS, AND ARIS'S TOTAL LIABILITY IS LIMITED TO THE FEES YOU PAID IN THE TWELVE MONTHS BEFORE THE CLAIM, OR US$50 IF NONE.
10. Indemnity
You will defend, indemnify, and hold harmless ARIS and its owner from any claim arising from your data, your use of the Service, or your breach of these Terms.
11. Termination
You may close your account at any time by emailing cody@aristrials.com. We may suspend or terminate accounts for breach, non-payment, or if we discontinue the Service, with reasonable notice where practical. Export your data before closing your account. Sections 5 through 13 survive termination.
12. Dispute resolution
The arbitration agreement, class action waiver, attorneys'-fees provision, and governing-law and venue terms in EULA sections 18 through 20 apply to these Terms and to any dispute concerning the Service.
13. Changes
We may update these Terms by posting a revised version with a new effective date. Material changes will be announced by email or in the portal. Continued use after the effective date is acceptance.
